Terms of Use — Rival Score

1. Acceptance

By using Rival Score you agree to these terms. Rival Score (the "app") is offered by Martech Consultoria Empresarial LTDA, CNPJ 12.815.687/0001-00 ("we" or "us").

If you do not agree, do not use the app. Use of the app is also subject to our Privacy Policy.

The app is not directed to children under 13. If you are between 13 and 18 years old, use the app with the knowledge of your parent or legal guardian.

The account (section 5) is for users aged 14 or older, and news by email and WhatsApp is only for users aged 18 or older. We do not ask for a date of birth: when you create an account, you declare that you are 14 or older; when you turn on news, you declare that you are 18 or older.

2. What Rival Score is

The app is free and displays sports results for informational purposes: live scores, match timelines, lineups, statistics, standings, head-to-head records, favorites, notifications, search and information on where to watch.

• The app does not broadcast matches, does not sell tickets and does not offer or promote betting.
• In this version the app does not show ads. We may start showing them in the future, with prior notice in the app and an update to the Privacy Policy.
• To measure the campaigns we use to promote Rival Score, the app uses Meta, TikTok and Google tools, only for users who declare they are 18 or older and with your campaign measurement permission, which you can withdraw in More › Privacy (Privacy Policy, section 3.5).
• We may add, change, suspend or remove features, competitions and sports at any time, for technical, contractual or business reasons.

3. Sports data

• Scores, events, lineups, statistics, standings and broadcast information come from third-party data providers and are processed automatically.
• The data may be delayed relative to the official broadcast. Even in live matches, there may be a difference of seconds or minutes between what happens on the field and what appears in the app.
• We do not guarantee real-time accuracy. The data may contain errors, omissions or later corrections (for example, a goal disallowed after review, a change of goalscorer, a match postponed or rescheduled). The official results are those published by the organizers of each competition.
• Where to watch information is indicative only: schedules and broadcast rights may change without notice, and the availability of each channel or service depends on a subscription and on your region.
• Do not use the information in the app as the sole basis for financial decisions, betting or any decision in which a delay or error could cause loss.

4. Notifications

• Notifications depend on the system permission, the device's connection and Apple's and Google's delivery services. They may be delayed, arrive out of order or not arrive at all.
• You choose the types of alerts and whom you receive them about in More › Notifications and with the bell icon on each match. Quiet hours, when turned on, suspend alerts during the chosen period.
• A notification may be sent before the data is corrected (for example, a goal that is later disallowed).

5. Optional account

• You can use the app without an account. In that case, we create an anonymous identifier to keep your favorites and preferences.
• If you want to sync your favorites across devices, you can sign in with Apple, Google or email (with email sign-in, we send a sign-in link to the address you enter, with no password). You are responsible for keeping access to that account.
• To create the account, provide your real first name, last name and email (prefilled by Apple or Google; with email sign-in, only the email is prefilled and you type your first and last name); the mobile number is optional. You can correct them in More › Edit profile. The account is for users aged 14 or older (section 1).
• News by email and WhatsApp is only for users aged 18 or older and is only sent if you allow it, separately from the account, and you can unsubscribe at any time in the app or in each message, as described in the Privacy Policy.
• You can sign out of the account at any time in More › Account and delete it in More › Delete account or at https://rivalscore.net/excluir-conta/en.
• We may suspend or terminate the access of anyone who violates these terms (section 7).

6. Intellectual property

• The app, the software, the design, our own texts and the Rival Score brand belong to Martech or are licensed to it.
• Names, trademarks, crests and logos of clubs, leagues, federations and competitions belong to their respective owners. They appear in the app only to identify the teams and competitions. Rival Score is an independent app and has no affiliation with, sponsorship by or approval from any club, league, federation or competition.
• The sports data is licensed from third parties and protected by their rights. You may not copy, extract, reproduce, redistribute or commercially use this data outside the app.
• We grant you a personal, non-exclusive, non-transferable, revocable and non-commercial license to use the app on your device, in accordance with these terms and the rules of the store from which you downloaded it.
• If you hold a right and believe that some content in the app infringes it, write to suporte@rivalscore.net identifying the content and the right. We will review it and, if appropriate, remove the content.

7. Conduct

When using the app, you agree not to:

1. extract data by automated means (scraping, bots, scripts) or access our servers by any means other than the app;
2. reverse engineer, decompile or modify the app, except where the law expressly allows it;
3. circumvent the protections of the app or the servers (for example, App Check, usage limits, access rules);
4. overload, interfere with or attempt to break into the service or other people's accounts;
5. use the app or its data for commercial purposes, including resale or display in other products;
6. send through feedback any content that is illegal, offensive, discriminatory, threatening or that violates the rights of third parties;
7. use the app in breach of the law.

8. Feedback

If you send suggestions or comments, we may use them to improve the app, with no obligation to pay or give credit. Do not include personal data in feedback beyond what is necessary.

9. Privacy

The processing of personal data follows the Privacy Policy, which is part of these terms. You can erase the data on this device in More › Clear app data.

10. Availability

We do our best to keep the app available and the data up to date, but the service is provided "as is" and "as available". Interruptions may occur due to maintenance, failures of data, cloud or connectivity providers, or reasons beyond our control. We may discontinue the app, giving reasonable advance notice whenever possible.

11. Limitation of liability

To the maximum extent permitted by applicable law:

• we are not liable for losses resulting from delay, error, omission or unavailability of the sports data or notifications;
• we are not liable for decisions made based on the information in the app, including bets or business dealings;
• we are not liable for the content, availability or practices of third-party websites, apps and services referred to in the app (for example, channels and streaming services in "Where to watch");
• we are not liable for failures of the device, the operating system, the connection or Apple's and Google's notification services.

Nothing in these terms excludes or limits rights that the law guarantees to consumers and that cannot be waived by contract, nor our liability for willful misconduct or gross negligence. This also applies to the consumer protection laws of Argentina, Chile, Peru and Mexico.

12. Termination

You can stop using the app at any time by uninstalling it and, if you have an account, deleting it. We may suspend or terminate your access if you violate these terms, if the law requires it or if the app is discontinued.

13. App store terms

You downloaded the app from the App Store (Apple) or Google Play (Google). The rules of these stores also apply to your use of the app. In case of conflict regarding the use of the store, the store's rules prevail.

For iPhone and iPad users (App Store):

1. These terms are entered into between you and Martech, and not with Apple. Martech, not Apple, is solely responsible for the app and its content.
2. The license in section 6 is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Martech is solely responsible for the maintenance and support of the app (suporte@rivalscore.net). Apple has no obligation to provide maintenance or support.
4. Because the app is free, Apple has no warranty obligation with respect to it. Any claim, loss or expense arising from a failure of the app to conform to a statutory warranty is Martech's responsibility, to the extent the law does not exclude it.
5. Martech, not Apple, is responsible for addressing claims relating to the app or its use, including: product liability; failure to comply with a legal or regulatory requirement; and claims arising under consumer protection, privacy or similar laws.
6. In the event of a claim that the app or your use of it infringes a third party's intellectual property rights, Martech, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
7. You represent that you are not located in a country that is subject to a United States government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.
8. Questions, complaints or requests about the app: Martech Consultoria Empresarial LTDA, suporte@rivalscore.net.
9. When using the app, you must comply with applicable third-party terms (for example, those of your data plan).
10. Apple and its subsidiaries are third-party beneficiaries of these terms and, by accepting them, you acknowledge that Apple may enforce them against you as a third-party beneficiary.

14. Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil. The courts of the judicial district of São Paulo/SP are chosen to resolve matters relating to them, without prejudice to the consumer's right to bring an action in the courts of their place of residence (Código de Defesa do Consumidor (Brazil's Consumer Protection Code), art. 101, I). For users residing in other countries, the rights guaranteed by the mandatory consumer protection and personal data rules of their country of residence are preserved.

15. Changes

We may update these terms; we will let you know in the app. If the change is significant, you will be notified before it takes effect and may stop using the app. Continuing to use the app after the notice means that you accept the new version. The effective date at the top indicates the current version.
